Shipping Policy

This Shipping Policy is part of, and incorporated by reference into, the Brux Aware Terms of Service. It applies to Products sold by MedSense Labs, LLC, doing business as Brux Aware (“we,” “us,” or “our”) through www.bruxaware.com. Capitalized terms have the meanings given in the Terms of Service. Nothing in this Policy limits any right you have under applicable consumer-protection law.
Order Processing
We aim to process and ship in-stock orders within a reasonable time after payment is accepted. Orders may be delayed for payment verification, fraud screening, address confirmation, inventory, or other operational reasons. We may fulfill an order in multiple shipments and may allocate limited inventory among customers in a commercially reasonable manner during high demand.
Shipping Methods, Estimates, and Costs
Available shipping methods, carriers, costs, and estimated delivery windows are shown at checkout and may vary by destination, Product, and inventory. All delivery dates and transit times are estimates only and are not guaranteed. Delays caused by carriers, customs, weather, or other events outside our reasonable control are not our responsibility, although we will reasonably assist you in resolving carrier issues. Shipping and handling charges, including expedited charges, are generally non-refundable except as stated in the Return & Refund Policy or required by law.
Pre-Orders, Reservations, and Backorders
For pre-ordered, reserved, or backordered Products, any ship or availability date is an estimate only and not guaranteed. Consistent with the FTC Mail, Internet, or Telephone Order Merchandise Rule, if we cannot ship within the time we stated at the time of your order (or within 30 days if no time was stated), we will notify you and give you the option to consent to the delay or to cancel for a full refund of amounts paid. VIP reservation deposits are governed by the Return & Refund Policy and the applicable promotional terms.
Shipping Address; Undeliverable Packages
You are responsible for providing a complete, accurate shipping address. If an address is incorrect or incomplete, we may delay or cancel the order, charge additional shipping/handling, or require verification. If a shipment is returned to us as undeliverable, refused, or unclaimed for reasons attributable to you, we may deduct reasonable shipping, handling, storage, and return costs from any refund otherwise available, to the extent permitted by law and the Return & Refund Policy.
Title and Risk of Loss
Unless applicable law provides otherwise, title and risk of loss pass to you when we deliver the Product to the carrier. Where mandatory consumer law provides that risk of loss remains with the seller until you receive the goods, that law controls. Please inspect your Product promptly on delivery.
Lost, Delayed, or Damaged Shipments
If your shipment appears lost in transit, arrives damaged, is incomplete, or contains the wrong Product, contact hello@bruxaware.com within a reasonable time after delivery or the expected delivery date. We may request photos or other information and will help investigate with the carrier and, where appropriate, repair, replace, resend, or refund per the Return & Refund Policy and Limited Warranty. Prompt notice helps preserve remedies but does not waive rights you have under applicable law.
International Shipments
Unless we expressly offer sales to a particular country, Products are intended for purchase and delivery within the United States. If we accept an international order, you are responsible for all import duties, taxes, customs, brokerage, and similar charges, and for ensuring the Product may lawfully be imported to your destination. We make no representation that a Product complies with the laws, labeling, certification, or radio-frequency requirements of jurisdictions outside those where it is offered, and we are not responsible for customs delays, seizures, or charges. International returns are subject to the Return & Refund Policy.
Shipping Restrictions
We may refuse or restrict shipment to any address, jurisdiction, individual, or entity where shipment would violate applicable law, export controls, sanctions, carrier rules, or our policies.
Packaging and Product Changes
We may modify packaging, accessories, documentation, or non-material components without affecting intended functionality. Minor cosmetic or packaging differences from promotional images are not defects.
